Maia ski terms and conditions

Maia Ski is a brand name for Sarah Wilcock, an Independent Ski Instructor, certified by the British Association of Snowsports Instructors and Swiss Snowsports. Registered with Berg Pro with Cantanal Authority to work independently in the Valais region of Switzerland. Sarah Wilcock will be referred to as SW. “You” “your” or “them” refers to the client.

All bookings are made with Sarah Wilcock. Your booking is not confirmed until payment is received in full. Upon making the booking and confirming the booking by making payment, you, the client, enters into this agreement.

1. General Cancellation Policy

In the event of cancellation, reimbursement will be calculated as a percentage of the total cost of all products booked, as follows:

  • Cancellation 29 days or more prior to the commencement of the first day: 90%

  • Cancellation 28-15 days prior to the commencement of the first day: 50%

  • Cancellation 14 days or less prior to the commencement of the first day: No refund

 

  • Cancellation due to injury or sickness of the client(s) or any other reason, whereby the client chooses not to participate despite it being possible for the lesson to take place, will not be refunded.

  • SW reserves the right to terminate or cancel a lesson where the client has misrepresented themselves or other guests when making the booking.

  • Clients are strongly advised to take out suitable insurance to cover them in the case of cancellation.

 

2.  Cancellation due to COVID-19

If you are unable to take attend the lesson due to any of the reasons below, you will receive a full refund for your booking:

  • If the resort where your lessons are due to take place is closed due to COVID-19.

  • If the border to the country where your lesson is due to take place is closed and you cannot enter the country.

  • In the event that SW has to cancel your lesson

  • If the border of your home country is closed and you cannot leave the country, or re-enter after your holiday. For the avoidance of doubt, in the event you cancel the lesson due to contracting COVID-19, you will be refunded in line with the General Cancellation Policy detailed above. We recommend ensuring you have the appropriate level of travel insurance to cover this situation.

 

3. Events out of control of SW

SW shall not be held responsible for the cancellation of a lesson, in the event where it was legally and/or physically impossible for the lesson to be performed e.g. in the event of a natural disaster, closing of airports, technical problems, threat of war, transportation accidents, fire, adverse weather conditions, excess or insufficient snow cover, power failure, disease outbreak, resort closure and/or volume restrictions on visitor numbers, or any other events beyond the control of SW, the client will not be entitled to a refund. Where possible reschedule will be offered and where a refund is requested, the general cancellation policy above will be applied. It is strongly advised that you have appropriate insurance in these instances.

4. Code of conduct

All clients participating in the ski lesson must act in a safe and appropriate manner. SW reserves the right to terminate the lesson, or remove and/or exclude the client, in the instance that SW deems them to be behaving unsafely and/or inappropriately.

5. Liability

SW will not be held responsible for any service not directly under her control, such as, but not limited to, ski lifts, airlines and world events.

SW will not be responsible for any additional expenses, distress, disappointment, loss, damage, injury, accident, delay, inconvenience or irregularity resulting from the act of any other company, firm or persons, unless caused by either the proven negligence of or lack of diligence by SW. Any claims with respect to such matters must be made against the appropriate principal.

SW has a 3rd Party Liability Policy with AXA Insurance. This provides indemnity in respect of legal liability to pay compensation for accidental injury to 3rd parties or accident loss or damage to their property.

 

6. Promotional Material

During your lessons, photographs or videos may be taken for promotional purposes or to provide feedback and additional instruction. If you do not want this to happen, it is your responsibility to inform your instructor beforehand.

7. Skiing is an extreme sport and it is undertaken at your own risk. It is strongly advised that you obtain appropriate insurance for participation in your ski lesson. SW cannot be held responsible for injury, losses, accidents or death during your ski lesson.
